Terms of Service

These Terms of Service (“Terms”) govern your access to and use of exploroff.com and related products, services, and features (the “Platform”), operated by Wasilco LLC doing business as ExplorOFF (“ExplorOFF”, “we”, “our”, or “us”). By using the Platform, listing an activity, or joining an activity, you agree to these Terms. If you do not agree, do not use the Platform.
1. What ExplorOFF is (and is not)
ExplorOFF provides a directory and discovery platform where local guides, outfitters, and hike organizers (“Organizers”) can list activities, and where travelers and hikers (“Participants”) can discover them. We may also link to or reference activities, listings, and bookings on third-party websites and platforms. ExplorOFF is not the provider, operator, or sponsor of any activity, and does not verify, guarantee, or take responsibility for any listing, Organizer, Participant, or third-party platform.
2. No responsibility for activities
To the fullest extent permitted by law, ExplorOFF is not responsible or liable for any activity listed, described, promoted, or referenced on the Platform, whether the activity is hosted on ExplorOFF or on any other third-party website or platform that ExplorOFF links to or refers to. This includes, without limitation, any injury, death, illness, accident, loss, theft, property damage, delay, cancellation, misrepresentation, dispute, or other harm arising before, during, or after any activity.
Participation in outdoor activities is inherently risky. You acknowledge and accept those risks and agree that you take part at your own risk and are responsible for your own safety and decisions.
3. Organizer responsibilities
By listing an activity, you (the Organizer) represent and agree that:
- You organize and run your activity entirely at your own risk and responsibility.
- You are solely responsible for the safety of your Participants and for how your activity is run.
- You will obtain and maintain all permits, licenses, insurance, authorizations, and permissions your activity requires, and you will follow all applicable laws and land, park, and trail regulations. If your activity is commercial and takes place on public lands, this includes any special-use permit or commercial use authorization required by the managing agency (see Section 3a).
- Your listing is accurate and not misleading, and you have the right to offer the activity.
- You are an independent operator. Nothing in these Terms creates an employment, agency, partnership, or joint-venture relationship with ExplorOFF.
3a. Public lands and special-use permits
Many activities on ExplorOFF take place on public lands. If you charge money for an activity (or otherwise run it commercially) on land managed by a government agency, that agency almost always requires you to hold its own authorization first, for example, a U.S. Forest Service special-use permit, a National Park Service Commercial Use Authorization (CUA), a Bureau of Land Management Special Recreation Permit, or a state, county, or local park permit.
By listing an activity that takes place on public lands, you (the Organizer) agree that:
- You alone are responsible for determining what authorizations your activity requires, and for obtaining, paying for, holding, and complying with them, including carrying the permit during the activity, following its conditions, and accurately describing the land and your authorization status in your listing.
- ExplorOFF does not obtain, hold, review, verify, or guarantee any permit or authorization for any Organizer, and is not a land-management or authorizing agency. Any statement an Organizer makes about their permits is their own, not ours.
- Publishing a listing on ExplorOFF is not a permit, is not evidence of any authorization, and does not mean any agency, or ExplorOFF, has approved your activity.
- Any fines, penalties, fees, damages (including damage to public lands or fire-suppression costs), or claims arising from operating without a required authorization are yours alone, and you will indemnify ExplorOFF for them as described in Section 9.
4. Participant responsibilities
If you join an activity, you are responsible for assessing whether it is appropriate for your fitness, skill, and health, for bringing suitable gear, and for your own conduct and safety. You deal directly with the Organizer, and any agreement for an activity is between you and the Organizer, not ExplorOFF.
5. Third-party platforms and links
The Platform may link to or reference third-party sites and services (for example, AllTrails, Facebook groups, and activity, lodging, or tour booking partners). We do not control and are not responsible for those sites, their content, availability, or the activities, bookings, or transactions offered on them. Your use of any third-party site is governed by that site's own terms and policies.
6. Assumption of risk and release
To the fullest extent permitted by law, you release and hold harmless ExplorOFF and its owners, employees, and affiliates from any and all claims, liabilities, damages, and expenses arising out of or relating to any activity or any interaction with an Organizer, Participant, or third-party platform found through the Platform.
7. Disclaimer of warranties
The Platform is provided “as is” and “as available”, without warranties of any kind, express or implied. We do not warrant that listings are accurate, that Organizers are qualified or vetted, or that any activity will meet your expectations or be safe.
8. Limitation of liability
To the fullest extent permitted by law, ExplorOFF will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the Platform or any activity. Our total liability for any claim relating to the Platform will not exceed the greater of the amount you paid us in the twelve months before the claim, or USD 100.
9. Indemnification
You agree to indemnify and hold ExplorOFF harmless from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your activities, your listings, your use of the Platform, or your violation of these Terms or any law or third-party rights.
10. Fees
Listing a free community activity is free. Certain paid listings or features may carry a fee, which will be disclosed before you incur it. Payments are processed by our payment provider (Stripe).
11. Accounts and eligibility
You must be at least 18 years old to create an account. You are responsible for your account and for keeping your credentials secure. We may suspend or remove listings or accounts that violate these Terms.
12. Changes to these Terms
We may update these Terms from time to time. We will post the updated Terms on this page and revise the “Last updated” date above. Your continued use of the Platform after changes take effect means you accept the updated Terms.
